Is this considered educational child neglect?

My husbands daughter spends the summers with us for visitation. She is 5. Last summer, we took her in for a developmental evaluation. It was recommended that she receive developmental, speech, and occupational therapy. We told mom and she did nothing about it. This summer, we took her back to the same place because over the past year, she has made no progress. We were worried that she was not going to be ready for kindergarten. She scored well under age level again and was recommended to receive the same three therapies. Can mom be charged with neglect for failing to get her daughter these therapies? We only want whats best for this child. We have even found numerous places where we live that she could benefit from. Any advice on what to do? We have tried talking to mom and she just ignores us.
